Overview
CCI’s Contract Review Service is intended to assess the compliance implications of an organization’s current physician contracts and other arrangements, including:
- Employment Relationships
- Medical Directorships
- Lease Agreements
- Joint Ventures
- and other investment interests
The review is performed in an attempt to identify any incentive arrangements or other terms which might be in violation of the anti-kickback statute, the self-referral laws, or other applicable regulations.
In addition to establishing the existence (or lack thereof) of documentation in support of each physician relationship, these reviews are intended to assess the specific duties to be performed by the physicians, the compensation and other consideration to be paid in exchange for the physician’s services, other noteworthy terms and conditions (such as loans, guarantees, leases, etc.), and the adequacy of the documentation itself.
With respect to lease arrangements, CCI will also evaluate their comparability with other similar arrangements and with prevailing market conditions. In addition, we are available to review other (nonphysician) contractual arrangements that could be impacted by prevailing laws and regulations, including contracts for various clinical and support services, management services, rental and consignment agreements, and specific billing and coding review services.
As with physician arrangements, these contracts will also be assessed as to their compliance with regulatory requirements and comparability to prevailing market conditions.
